SC Verdict-Relief for Students of Private Dental Colleges

Supreme Court Order: BDS Degrees Validated

The Supreme Court has issued a significant ruling, providing significant relief to students studying in private dental colleges. The court has declared the Bachelor of Dental Surgery (BDS) degrees of students who enrolled in private dental colleges in Rajasthan despite scoring below the required percentile in the NEET 2016-17 session as valid.

This decision has secured the future of hundreds of students who had been in a state of uncertainty for the past several years.

What is the whole matter?

In 2016-17, some private dental colleges in Rajasthan admitted students to the BDS course by relaxing the NEET percentile. The matter later reached the court because, according to a previous 2016 Supreme Court decision, admission to medical courses like MBBS and BDS can only be granted on the basis of NEET merit.

On Thursday (19 December), keeping the interests of the students in mind, the bench comprising Justices JK Maheshwari and Vijay Bishnoi clarified that the students were not at fault, and therefore their degrees cannot be invalidated. The court declared the degrees of students pursuing BDS from 11 private dental colleges in Rajasthan as regular and valid.

Fines on Colleges and State Government

However, the Supreme Court held the private dental colleges and the state government responsible for violating the rules. The court clearly stated that not following the rules in the admission process was a serious lapse. Consequently, the concerned private colleges and the state government were also fined.

Students must submit an undertaking

Along with the relief, the court also imposed a condition on the students. All students availing of this decision will have to submit an undertaking before the Registrar (Judicial) of the Rajasthan High Court.

Under this undertaking, the students will have to provide a pro-bono service to the state of Rajasthan for a maximum of two years during their lifetime. This service will be provided in the event of natural disasters, man-made disasters, accidents, or any health emergency declared by the government.

Eight-week deadline set

The Supreme Court has clearly directed that all concerned students must submit this undertaking within eight weeks. If the state requires their services in any special circumstances in the future, students must offer their services without hesitation.

Security for students’ future

This decision has brought great relief to students who have completed their dental studies with years of hard work but were unsure about the validity of their degrees. This Supreme Court decision sends the message that students cannot be punished for no fault of their own.

This Supreme Court decision not only brings relief to students studying in private dental colleges, but also warns medical and dental colleges to strictly adhere to the rules in the admission process in the future. This decision is considered an important step towards transparency in the education system and protection of students’ rights.
